Definitions:
 In these terms, “Applicable Laws” means all relevant laws, rules, regulations, and policies set forth by the government or authorized bodies. “Governmental Authority” refers to any governmental or statutory entity with legislative, judicial, regulatory, or administrative functions. “User” is any person who formally enrolls to use Cyoride’s vehicles and services, accepting the terms and conditions stated here. “Non-Reserving User” and “Reserving User” are specified in Clause 6.3. “Cyoride Vehicle” represents a vehicle provided by Cyoride for rental. “Scheme” pertains to Cyoride’s car-club program offering self-drive services. “Terms” denotes these terms and conditions, subject to updates and modifications. “Website” refers to the Cyoride website as mentioned in Recital 1.
In these Terms, unless stated otherwise:

- Singular words include the plural and vice versa, and words denoting a gender include all other genders.
- Headings are for convenience and do not affect interpretation.
- References to Recitals, Clauses, Sub-Clauses, and Schedules are to those mentioned in these Terms.
- Consent or approval must be in writing, and writing includes legible and non-transitory forms of reproducing words.
- References to documents include amended, consolidated, supplemented, novated, or replaced versions.
- References to statutes include modifications, re-enactments, replacements, and subordinate legislation or regulations made under them.
- Definitions apply to grammatical variations and cognate forms.
- The rule of construction against the drafter does not apply.
- Expressions like “hereof” and “herein” refer to the entire Terms, not just a specific section.
- “Include” and “including” imply without limitation.
- References to rupees (Rs.) denote lawful currency of India.
- Schedules are integral to these Terms and hold the same force and effect as if expressly included in the body of the terms.
Cyoride’s website contains the displayed terms and conditions for using Cyoride’s vehicles, and Users must ask for a soft copy of the agreement if they can’t access it online.
The User has read and understood the terms and conditions, including those regarding car rentals, fees, privacy policy, and confidentiality. Cyoride reserves the right to change these terms with notice to the User, and the updated terms become effective on the date of posting.
Use of Cyoride’s vehicles or services signifies acceptance of all terms and conditions, including any future amendments.
By accepting these terms, the User enrolls under the Scheme to access Cyoride’s rental facility.
The User acknowledges not challenging these terms or the website’s content based on unreadiness or lack of awareness of enrollment formalities or provisions.
The terms “User” and “Customer” have no distinction; they both refer to individuals registered and hiring Cyoride’s vehicles.
To enroll as a user with Cyoride, you must meet the following criteria:

- Be at least 21 years old.
- Be an Indian citizen with a valid Light Motor Vehicle (Non Transport) Indian license, at least 1 year old.
- Have a good driving record without any offence involving moral turpitude or Motor Vehicles Act violations that lead to imprisonment for more than 6 months.
To enroll, you need to provide the necessary information as instructed by Cyoride’s representatives. This includes:
- A photo of your valid driving license.
- Credit/debit card details if you prefer this mode of payment.
- Any other documents requested by Cyoride.
- Cyoride reserves the right to decline enrollment without giving a reason. Rejected users won’t be allowed to use or rent any Cyoride vehicle.
To book a Cyoride vehicle, follow these steps:

- Choose the preferred vehicle from the available options on the website.
- Select the start and end date and time for the vehicle’s usage.
- Provide delivery and return addresses.
- Pay the fees using the available payment systems.
- Cancellation and Extension
Â
For cancellations or shortening the reservation period, inform us in advance as per the Fee Policy. To extend a reservation, request an extension from Cyoride before the outlined timeline in the Fee Policy. Cyoride has the discretion to accept or refuse extension requests based on availability and advance payment.
Upon advanced payment, Cyoride is responsible for:

- Providing the booked vehicle at the specified time and location.
- Compensating or refunding in case of service cancellation.
- Ensuring the vehicle is in good condition, well-maintained, and follows the prescribed maintenance schedule.
- Providing assistance in case of breakdown due to mechanical/electrical failure, not caused by the user.
- Permitted Users of Cyoride Vehicles

Cyoride vehicles are provided on rental basis only to eligible users. Users are responsible for ensuring that the vehicle is not used by unauthorized individuals. Users can allow others to drive the vehicle but remain liable for compliance with the terms and conditions.

The following uses of Cyoride vehicles are strictly prohibited:
- Engaging in speed racing or competitions.
- Towing or pushing other vehicles.
- Operating as a taxi service or transporting people for commercial purposes.
- Driving under the influence of alcohol, drugs, or medications that impair driving.
- Using the vehicle for illegal or criminal activities.
- Driving imprudently, negligently, or abusively.
- Providing false information to Cyoride.
- Driving outside the territorial boundaries of India or restricted areas within the country.
- Using a mobile phone or similar device while driving.
- Transporting hazardous substances or objects that may impact vehicle safety.
- Carrying more passengers than the authorized number of seat belts.
- Using tobacco, drugs, or psychotropic substances inside Cyoride vehicles.
- Burning substances, transporting animals, or conducting activities that affect the vehicle’s normal conditions.
- Please adhere to these guidelines to enjoy a safe and smooth experience with Cyoride services.
By agreeing to the Terms, you authorize Cyoride to access your driving records from the relevant jurisdiction where you hold a license.

You are responsible for providing and maintaining accurate account information with Cyoride, including your current email, mobile number, and address.
Â
Keep your Cyoride-related passwords and PIN numbers confidential, and do not share them with third parties. In case of a written or electronic record of your PIN or password, you will be accountable for any unauthorized use by third parties. If you suspect unauthorized access, change your compromised password and/or PIN following the procedure on the website.
Â
While using a Cyoride vehicle, follow the owner’s manual instructions located in the vehicle’s glove compartment. If any issues arise that may affect the vehicle’s operation or safety, immediately inform Cyoride and follow their instructions.
During the rental period, Cyoride retains effective control over the vehicle. If any terms and conditions are violated, Cyoride may exercise this control. All Cyoride vehicles are equipped with GPS and speed trackers for remote access.
- Before taking possession of a Cyoride Vehicle, perform an exterior and interior inspection.
- You can test drive the vehicle to ensure no damage or issues are present, informing Cyoride of any encountered abnormalities before taking possession.
- You are responsible for returning the selected Cyoride Vehicle in good working order, clean, and secured to the same location by the end time of your reservation.
- The actual fuel expenses incurred during your trip will be charged to you with no markup.
- Cyoride pays the fuel expenses to third-party suppliers on your behalf.
- Cyoride procures the fuel exclusively for you and does not hold any title to it.
- Report any condition that impairs the vehicle’s driving functionality or safety immediately to Cyoride, including any damage, abnormal noises, or warning lights.
- Inform Cyoride before performing a jump start on any vehicle, as you will be liable for any resulting losses.
- Leave the vehicle’s key, key fob, or starting device, as well as parking and toll payment passes, in their proper places upon returning the vehicle. Failure to do so may result in additional charges.
If you return the Cyoride Vehicle late, you will be responsible for paying late fees and any inconvenience charges as per Cyoride’s Fee Policy.
Report any information about stolen vehicles to the nearest police station and provide a copy of the complaint to Cyoride to ensure valid insurance or other claims.
- Follow all seat belt and child restraint laws and properly use child passenger restraint systems as required by local regulations.
- Always secure the vehicle by closing windows and locking the car when parking.
- Report any breakdowns or incidents involving Cyoride vehicles to Cyoride.
- In case of property damage or incidents involving third parties, fill out an official police report and complete Cyoride’s incident report form.
- Notify Cyoride of any traffic violations within the prescribed deadline.
- Do not park the vehicle in zones with parking restrictions, as you will be responsible for any violation notices or towing charges incurred by Cyoride.
- Cyoride strives to provide roadside assistance support in all cases.
- Pay the specified Fees for your booking duration either at the time of booking or during vehicle delivery.
- Make payments using credit/debit cards or other net banking facilities with sufficient funds to cover any charges.
- If payments are defaulted, late fees and default interest at 24% per annum may apply.
- Cyoride may use third parties to collect owed amounts and report delays to credit rating agencies.
- Any outstanding fees may prohibit you from making future reservations.
- If your driver’s license expires or gets revoked, your authorization to drive Cyoride vehicles will immediately expire. Notify Cyoride via email of any license revocation.
- Any actions that affect the normal condition of the vehicle must be reported to Cyoride promptly.
- Cyoride may suspend or terminate the use of its service by any User who doesn’t meet Cyoride’s driving eligibility requirements or engages in unreasonable or inappropriate use of a Cyoride vehicle, as determined by Cyoride in its sole discretion or for violating any provisions mentioned in this agreement.
- Cyoride also reserves the right to suspend or terminate the service of any User for driving-related issues, such as warning lamps, indicators, strange sounds, or smells, or performance changes.
- Cyoride holds the right to cancel any booking and recall the vehicle at any time. It also reserves sole discretion in serving individuals and organizations.
If Cyoride is not notified of a problem at the start of a reservation, Cyoride may suspend or terminate the service of the User and charge a damage fee, cleaning fee, or other applicable fees.
- Users are responsible for indemnifying and holding Cyoride, its parent, and affiliates, as well as their respective directors, officers, employees, shareholders, agents, attorneys, assigns, and successors-in-interest harmless for any losses, liabilities, damages, injuries, claims, demands, costs, attorney fees, and other expenses incurred by Cyoride arising from a breach of the Terms specified herein.

Users who violate the law or any provisions of this agreement or the rules set up by Cyoride may face legal action and be held responsible for all damages, liability, and fines as mentioned in the Fee Policy.
- Cyoride captures, stores, processes, and uses the Customer’s personal data, including usage and vehicle data, for the administration and implementation of this Agreement and the Customer’s use of the Cyoride vehicle.
- If third-party services are used, Cyoride may forward the Customer’s personal data to the third-party service provider as required to fulfill customer requirements.
- Cyoride may provide Customer’s personal data to third parties for individualized offers, services, and other customized information to Customers.
- Cyoride maintains reasonable procedures for protecting sensitive personal information in compliance with applicable law.
Cyoride may disclose User information to Cyoride’s parent company, its affiliates, and any government body as required by law or by directive or request from any government body or any third party deemed appropriate by Cyoride, at its absolute discretion.

In case of any disputes arising under or in relation to these Terms, the matter shall be referred to binding arbitration according to the Arbitration and Conciliation Act, 1996 or any statutory modification or alteration thereof for the time being in force. The arbitral tribunal shall comprise a sole arbitrator appointed by Cyoride, and their decision shall be final and binding.

The arbitration proceedings shall be conducted in the English language with the seat of arbitration in New Delhi.
These Terms shall be governed by the substantive laws of India, without regard to the conflict of laws provisions. The courts in New Delhi shall have exclusive jurisdiction over all matters pertaining to this Agreement.
Users must not encourage third-party claims against Cyoride and must cooperate fully in any claim or lawsuit involving Cyoride’s vehicles.
Users must immediately notify Cyoride of any summons, complaint, document, or notice related to an accident, theft, or other circumstances involving the Cyoride vehicle.
Cyoride uses cookies and other technologies to collect non-identifiable information. Users may control the effect of cookies through their browser settings, but some features of Cyoride’s service may not work properly if cookies are disabled.
Cyoride’s website may contain links to third-party websites, and users should review the privacy practices of those third parties.
Cyoride takes precautions to safeguard user personal information, but it cannot guarantee complete security.
Users are responsible for the confidentiality of their account and password, as well as all activities under their account.

Upon accepting these terms, the User acknowledges the following:
- Cyoride operates a Website at www.cyoride.com, displaying the FMS terms and conditions.
- Users must read and understand these terms, including fee schedule and privacy policy, to use Cyoride’s services.
- Cyoride reserves the right to modify these terms with prior notice to the User.
- Users’ acceptance of these terms implies agreement to all conditions, even if amended later.
By accepting these Terms and Conditions, Users enroll in the FMS Scheme provided by Cyoride.
Users cannot challenge the terms, claiming non-awareness, understanding, or enrollment formalities.
There is no distinction between Users and Customers; they are the same.
- Users must provide necessary details as indicated by Cyoride’s representatives for enrollment.
- Required documents include credit/debit card details (if preferred for payment) and vehicle registration number (if not already available with Cyoride).
- Cyoride may reject any person as a User without providing a reason, and rejected individuals cannot use Cyoride’s FMS.
To avail of Cyoride’s FMS, users can select the desired services on the website and provide the start and end dates for the required period. If the vehicle details are not available in Cyoride’s records, users must provide them during booking. The fees for the services can be paid using any of the available payment systems on Cyoride’s platform.
If a user wishes to extend the FMS duration, they should request an extension from Cyoride before the specified timeline in the Fee Policy. Cyoride holds the sole discretion to approve or refuse the extension request based on feasibility and advance payment of fees for the extended period.
Upon payment of fees in advance, Cyoride is responsible for providing the following services to the user:
- Pick and drop facility, if required.
- Ensuring the vehicle under FMS is well-maintained and in good condition as per automotive OEMs’ maintenance schedule.
Assisting in case of vehicle breakdown due to mechanical or electrical failures, not caused by the user’s driving behavior or consequential damage.
Cyoride makes reasonable efforts to provide roadside assistance support. However, if the need for roadside assistance arises due to a breach of the Terms and Conditions, the user may be charged the full costs of the service.
Users are required to pay the service fees while selecting services on Cyoride’s web platform. Payments can be made using credit cards, debit cards, or net banking facilities. Users must ensure sufficient funds or credit in the account to cover charges and are responsible for associated bank or credit card fees.
In case of default on payments, Cyoride can charge remainder fees and default interest at 24% per annum. Cyoride may also use third parties to collect amounts owed by users and report delays to credit rating agencies.
Cyoride provides primary liability protection under FMS for claims and liabilities covered by vehicle insurance, rented from Cyoride, arising from the user’s use or operation of the vehicle. Users shall be responsible for any associated deductible charges and losses exceeding the coverage provided by Cyoride.
Cyoride is not responsible for damage, loss, or theft of personal property belonging to users or third parties, regardless of fault or negligence.
Users indemnify and hold Cyoride, its parent, affiliates, and respective directors, officers, employees, shareholders, agents, attorneys, assigns, and successors-in-interest harmless for all losses, liabilities, damages, injuries, claims, demands, costs, attorney fees, and other expenses arising from a breach of the specified Terms and Conditions.
Any user who violates the law, the agreements, or the rules set up by Cyoride may face legal action and be responsible for all damages, liability, and fines as mentioned in the Fee Policy.
- Cyoride collects, stores, processes, and uses the customer’s personal data, including usage and vehicle data, to manage this agreement and the customer’s use of Cyoride’s services.
- If necessary, Cyoride may share the customer’s personal data with third-party service providers to fulfill requirements.
- Cyoride may use the customer’s personal data to provide individualized offers, services, and customized information.
- Cyoride follows reasonable procedures to protect sensitive personal information as per applicable law.
- Cyoride may disclose user information to its parent company, affiliates, government bodies, or third parties as required by law or its discretion.
- Refer to the Privacy Policy on the website for more details.
In case of disputes between a user and Cyoride, they shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with New Delhi as the seat of arbitration.
The arbitral tribunal’s decision on any dispute shall be final and binding.
The arbitration proceedings shall be conducted in English.
The costs of arbitration shall be fixed by the arbitral tribunal, specifying the party entitled to costs, the party who shall pay the costs, the amount, and the manner of payment.

These terms shall be governed by the substantive laws of India, with New Delhi courts having exclusive jurisdiction.

User shall not aid or encourage third-party claims against Cyoride and must cooperate in the investigation and defense of any claim or lawsuit.
If any term of this agreement is invalid, the remaining provisions shall remain in force, and a valid provision will replace the invalid one.
User represents they have not relied on any representation or assurance outside of these terms.
Cyoride uses cookies and other technologies to collect non-identifiable information for enhancing services.
Users may control cookies through browser settings, but disabling cookies may affect some features.
Links to third-party websites may have their own privacy practices.
